The Illinois Supreme Court has ruled against the city of Danville in a case involving an injury. The justices unanimously disagreed with decisions granting the city of Danville immunity to a civil suit stemming from an unrepaired sidewalk. In a 2013 case plaintiff Barbara Monson said she had been in downtown Danville when she tripped on an uneven sidewalk slab. Monson fractured her shoulder, suffered other injuries, and has undergone three surgeries, according to her attorney. The original complaint alleged the city failed in its duty to maintain its property in a reasonably safe condition.
Monson’s case was appealed to the state Supreme Court after negative rulings from both the Vermilion County Circuit Court and the Fourth District Appellate Court. The case now will be sent back to Vermilion County Circuit Court.
